āLegal Notice and Identification
The Tennis Pass platform is a project developed and operated by Barras Digital, headquartered in Sion (Valais), registered in the Commercial Register under number CHE-309.688.102.
In these Terms, the terms "Tennis Pass", "We", or "The Platform" refer to the company Barras Digital.
āThe Tennis Pass Concept
Tennis Pass offers an annual subscription providing access rights to the facilities of partner tennis clubs. It is valid from 1 April to 31 March of the following year. Tennis Pass acts as a facilitating intermediary and not as the direct operator of the courts.
āAccess and Booking Terms
The subscriber acknowledges that actual court reservations are made through each partner club's own booking systems (e.g. Plugin, BalleJaune, etc.).
Tennis Pass cannot be held responsible for technical malfunctions, scheduling errors, or software unavailability within each club's booking systems.
The Tennis Pass subscriber agrees to strictly comply with the internal rules of each club visited (appropriate attire, clean tennis shoes, opening hours).
Tennis Pass does not guarantee the immediate availability of a court. However, Tennis Pass subscribers have the same access and booking conditions as local club members.
āList of Partner Clubs
The list of partner clubs may change during the season. The addition or removal of a club does not constitute grounds for early termination or a refund of the subscription.
The Pass price is the one in effect at the time of purchase. The Publisher reserves the right to modify the sale price of the Pass at any time during the season, particularly in the event of an expansion of the partner club network. However, the price is guaranteed for the entire validity period of the Pass once the order has been confirmed:
- No additional charge will be required from the User if new partner clubs are added during the season.
- No reduction or partial refund may be claimed in the event of a partner club's withdrawal.
āMain Club and Playing Rights
The Tennis Pass grants each User identical booking and court access rights at all partner clubs in the network, without distinction.
At the time of subscription, the User must designate a "Main Club". This choice is final for the current season. The User acknowledges that access to services related to the internal life of clubs (including participation in Inter-club competitions, internal tournaments, or preferential rates on group lessons) may be strictly reserved by certain clubs to subscribers who have designated that club as their "Main Club". Tennis Pass does not guarantee access to these additional services at other clubs in the network.
āThe "Upgrade to Tennis Pass" Product
For users who are already members of a partner club at the time of purchase, a preferential "Upgrade" rate may be applied. The amount of the deduction is calculated based on the standard membership fee already paid to the partner club.
Tennis Pass reserves the right to verify the User's eligibility with the relevant club before final validation of the subscription.
āPricing and Nominative Pass
The Tennis Pass is strictly personal and non-transferable. Identity checks may be carried out by the partner club.
Access to courts for a partner who is not a Tennis Pass member remains subject to the "guest" rates in force at the partner club, at the exclusive expense of the subscriber or their partner.
Any loan of a pass to a third party will result in the immediate cancellation of the subscription without refund.
āAccount Creation and Access
Purchasing a Tennis Pass automatically creates a personal user account based on the email address provided at the time of order. Login credentials are sent immediately by email after payment is confirmed. This account is essential to activate the Pass and access the booking systems of partner clubs.
In the event of a check by a partner club, the subscriber must show their Tennis Pass account confirming that it is active.
āLiability and Insurance
Tennis Pass accepts no liability for any accident, injury, or theft occurring on the premises of a partner club. The subscriber must be covered by their own Personal Liability (RC) and accident insurance.
Any damage caused by the subscriber at a partner club is under their sole responsibility.
āSuspension and Force Majeure
If a partner club becomes inaccessible (due to construction, weather, insolvency), Tennis Pass cannot be held responsible for the temporary inability to play at a specific location.
āRight of Withdrawal
All sales are firm and final upon payment confirmation.
āPurchase via Third Parties and Resale
A Tennis Pass must be purchased exclusively on the official website (tennispass.ch).
Any pass acquired from a third party (individual, resale platform, etc.) is considered invalid and will not grant access to any partner clubs.
The resale of a Tennis Pass, whether free of charge or for consideration, is strictly prohibited. Tennis Pass reserves the right to block without notice or refund any account suspected of unlawful transfer.
āApplicable Law and Jurisdiction
These Terms and all relations between Tennis Pass and the User are governed exclusively by Swiss law, to the exclusion of any conflict of laws rules.
In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing agreement, the exclusive place of jurisdiction is Sion (Valais), subject to appeal to the Federal Court.
